SUBJECT AND PURPOSE OF THE LAW

The Law on the State Inspectorate (Official Gazette 115/18) entered into force on April 1, 2019 years.

This Law regulates the organization of the State Inspectorate, management, conditions for performing inspection tasks within the purview of the State Inspectorate, duties and powers of inspectors for the purpose of protecting the public interest and public health interest in the implementation of regulations, and misdemeanor liability.

ORGANIZATION AND HEADQUARTERS OF THE STATE INSPECTORATE

– The State Inspectorate is a central state office.

– The seat of the State Inspectorate is in Zagreb.

INTERNAL ORGANIZATION

A central office in Zagreb, regional offices and branches of regional offices are set up to perform tasks within the scope of the State Inspectorate.

MANAGEMENT OF THE STATE INSPECTORATE

The work of the State Inspectorate is managed by the Chief State Inspector, who is a state official. The Chief State Inspector is appointed by the Government of the Republic of Croatia on the proposal of the Prime Minister for a period of five years.

The Chief State Inspector is responsible for his work to the Government of the Republic of Croatia.

SCOPE OF THE STATE INSPECTORATE

The State Inspectorate performs inspection tasks in the area of:

– trade, services, consumer protection, safety of non-food products

– food, including genetically modified food and new food, genetically modified organisms (hereinafter: GMO), prevention and suppression of infectious diseases, production and placing on the market of general use items, placing on the market and use of biocidal products, noise protection and protection from non-ionizing radiation, limiting the use of tobacco and related products, production, placing on the market and use of dangerous chemicals and management of toxic chemicals

– veterinary and food safety, which includes the protection of animal health and welfare, reproduction, keeping, breeding of animals, transport and labeling of animals, food and animal feed, veterinary medicinal products, animal by-products and veterinary environmental protection

– agriculture, hunting, forestry, plant health, plant protection products, sustainable use of pesticides and pesticide residues

– seeds and planting material of agricultural plants, forest reproduction material, prevention of the introduction and spread of foreign and invasive alien species and their management

– catering activities, provision of catering services, provision of services in tourism, residence or tourist tax

– mining, pressure equipment, energy (electricity, heating and gas, energy efficiency, hydrocarbons and geothermal waters for energy purposes, natural gas storage and permanent disposal of carbon dioxide)

– work and safety at work

– construction, implementation of expert supervision of construction, maintenance and use of buildings

– environmental protection, sustainable waste management, air protection, protection from light pollution, nature protection, water management and water for human consumption.

STATE INSPECTORATE INSPECTIONS

Inspection tasks within the scope of the State Inspectorate, in accordance with Articles 5 – 28 of this Act, are performed by market inspection, sanitary inspection, veterinary inspection, agricultural inspection, hunting inspection, forestry inspection, phytosanitary inspection, tourist inspection, mining inspection, pressure equipment inspection, energy inspection, toxic chemicals management inspection, work inspection, construction inspection, environmental protection inspection, nature protection inspection and water law inspection.

SCOPE OF THE TOURIST INSPECTION

Inspection tasks in the field of hospitality, provision of hospitality services, provision of services in tourism and residence or tourist tax are performed by the tourist inspection.
